REPEAL OF THE DEATH PENALTY
16-11-901. Death penalty repeal - applicability - current sentences. FOR OFFENSES CHARGED ON OR AFTER JULY 1, 2020, THE DEATH PENALTY IS NOT A SENTENCING OPTION FOR A DEFENDANT CONVICTED OF A CLASS 1 FELONY IN THE STATE OF COLORADO. NOTHING IN THIS SECTION COMMUTES OR ALTERS THE SENTENCE OF A DEFENDANT CONVICTED OF AN OFFENSE CHARGED PRIOR TO JULY 1, 2020.
SB20-200 will be on the Senate floor today (Jan. 30) for debate.
As you can see, the three perpetrators who are currently on death row are excluded.
I will not be supporting this bill as I believe the real concern should be about the victim.
If heinous murders did not happen, we would not be having this debate. Call it my deep roots in southern Colorado and my older age, but I believe it is our duty to seek the ultimate punishment for crimes of this nature.
Is the death penalty a deterrent? For me it is. We tend to forget about the victims and concentrate on perpetrator’s reasons why he/she committed this act of terrorism against our neighbor or family member.
Is it expensive to seek the death penalty? You bet it is and that is why district attorneys will plea bargain life imprisonment using the threat of death penalty to come to a conclusion of a case.
I do not believe eliminating the death penalty makes us a better society. Justice should be served.
