Thomas Bailey was charged with reckless manslaughter following a motion to amend by Third Judicial District Attorney Henry Solano on Nov. 4.
The amendment comes following weeks of evaluating evidence provided to Solano’s office regarding the death of Elizabeth Everhart.
“The evidence shows the defendant gave heroin to the victim, Elizabeth Everhart, which in whole or in part caused her death,” said Solano in his amended charge. “Between and including June 15, 2020 and June 20, 2020, Thomas Gene Bailey unlawfully, feloniously, and recklessly caused the death of Everhart.”
In addition to manslaughter, Bailey was also charged with tampering with a deceased human body, tampering with physical evidence, and assault in the third degree.
“The process of criminal investigation and criminal charging is a process that begins with information and can change over time based upon additional investigations and information,” said Solano. “We have determined, based upon the information available to us, that in good faith we believe that the addition of reckless manslaughter is an appropriate charge in this circumstance.”
Solano added that it must be understood that with these charges currently only allegations, Bailey is presumed innocent unless and until proven guilty in court. The preliminary hearing for Bailey is listed on the Las Animas County court docket for 9 a.m. on Monday, Nov. 23.
